This disclaimer contains important limitations and exclusions regarding Next Inspections services. By booking an inspection with us, you acknowledge that you have read, understood, and agree to all terms contained herein.
1. Visual Inspection Only
A home inspection is a non-invasive, visual examination of a property's accessible components. It is NOT:
- A complete guarantee that all defects will be found
- An exhaustive assessment of every component or system
- An engineering inspection or structural analysis
- A code compliance review or building permit verification
- An appraisal or valuation of the property
- A pest or termite inspection
- A mold or radon assessment (laboratory testing available separately)
2. Hidden & Inaccessible Areas
Many defects are hidden behind walls, ceilings, flooring, or finished surfaces. We CANNOT detect:
- Problems concealed by furniture, fixtures, or stored items
- Defects in attics, crawlspaces, or areas blocked by insulation
- Structural issues, foundation cracks, or water intrusion below grade
- Wiring, plumbing, or HVAC ducts hidden within walls
- Roof leaks or water damage that have dried and are no longer visible
- Previous water damage, mold, or repairs covered by fresh paint or drywall
- Termite damage or pest infestations inside cavities
- Asbestos, lead paint, or other hazardous materials (laboratory testing required)
3. Component Failure After Inspection
The inspection provides a snapshot of conditions on the date of inspection only. We cannot predict future failures. Components may:
- Fail or deteriorate immediately after inspection
- Be on the verge of failure but still functional during inspection
- Have intermittent problems that don't manifest during the 2-4 hour inspection window
- Develop defects due to use, weather, or age following inspection completion
Next Inspections is not responsible for component failures occurring after the inspection date.
4. Excluded Components & Systems
The following are typically not included in a standard home inspection and require separate evaluation:
- Thermal Imaging & Infrared: Requires specialized equipment (available for additional fee)
- Radon Testing: Multi-day laboratory test (referral provided; $200-400 typical cost)
- Mold Assessment & Testing: Lab testing recommended for suspected mold (referral provided)
- Asbestos, Lead Paint, or Hazardous Materials: Requires laboratory sampling and analysis
- Septic or Well Systems: Requires specialized technician evaluation
- Pool or Spa Equipment: May be evaluated but not fully tested
- Roof Condition (Age Estimation): Visual inspection only; intrusive testing not included
- Pest & Termite Inspection: Requires specialized pest control professional
- Energy Efficiency & Weatherization: Not included in standard inspection
- Fireplace & Chimney Inspection: Does not include flue cleaning or blockage assessment
5. Property-Specific Limitations
Certain property types and conditions present inspection limitations:
- Older Homes: May have outdated systems or construction methods no longer in compliance with current codes. This does not mean the home is unsafe or defective.
- Occupied Properties: Personal belongings may conceal defects or prevent full access to certain areas.
- Vacant Properties: Non-functioning utilities may prevent testing of systems (e.g., water, gas, electricity).
- Foreclosures or Bank-Owned Properties: May have been vacant for extended periods or subject to deferred maintenance.
- New Construction: May have latent defects not yet visible. New home warranty inspection performed within 2-5-10 year window recommended.
- Condos & Strata Properties: Common area systems (roof, foundation, exterior) are the responsibility of the strata council and are not included in individual unit inspections.
6. Seasonal & Weather Limitations
Certain findings may only be visible during specific seasons or weather conditions:
- Water intrusion and roof leaks are best identified during or after rain
- Ice dams and attic moisture are visible primarily in winter
- Basement moisture or efflorescence may not be apparent during dry seasons
- HVAC system performance may vary by season; inspection may not fully test cooling or heating capacity
We recommend follow-up inspections or monitoring during different seasons if concerns exist.
7. Professional Opinion & Not Legal Advice
The home inspection report represents the professional opinion of the inspector based on visual observation. It is not:
- Legal advice regarding property condition or liability
- A guarantee of property condition or longevity
- A cost estimate for repairs or replacements
- Advice on whether to proceed with or withdraw from a real estate transaction
- Warranty of habitability or fitness for a specific purpose
You are encouraged to seek advice from contractors, engineers, attorneys, or other specialists for further evaluation of reported findings.
8. No Warranty of Inspection Quality
While Next Inspections performs inspections professionally and in accordance with industry standards, we do not warrant that:
- All defects will be identified
- The inspection will prevent property damage or loss
- The report will satisfy all parties to a real estate transaction
- Recommendations in the report will resolve all issues
9. Liability Limitations
TO THE FULLEST EXTENT PERMITTED BY LAW, NEXT INSPECTIONS SHALL NOT BE LIABLE FOR:
- Any defects not identified during the inspection
- Property damage occurring after the inspection date
- Personal injury at the property (except where caused by negligence of the inspector)
- Loss of the real estate transaction or change in property value
- Consequential, incidental, or indirect damages
- Damages exceeding the cost of the inspection
- Claims arising from misinterpretation or misuse of the report by third parties
10. Contractor Referrals & Recommendations
If we recommend contractors, specialists, or service providers for further evaluation or repair, we do so for convenience only. We do not endorse or guarantee their work. You are responsible for vetting contractors and obtaining competitive bids. Next Inspections is not liable for the quality, cost, or performance of work performed by recommended contractors.
11. Insurance & Professional Liability
Next Inspections maintains professional liability insurance. However, liability insurance has limits, exclusions, and deductibles that may not cover all claims. The existence of insurance does not expand our legal liability beyond the limitations stated in this disclaimer and our Terms of Service.
12. Right to Decline or Limit Inspection
Next Inspections reserves the right to:
- Decline to inspect a property if safety risks are present
- Limit inspection to accessible areas only
- Refuse to test systems that appear unsafe or non-functional
- Recommend further evaluation by specialists for hazardous conditions
No refund will be issued if the client cannot provide safe access or utilities are unavailable.
13. Report Accuracy & Good Faith
The inspection report is prepared in good faith based on conditions observed during the inspection. While we strive for accuracy, errors or omissions may occur. If you identify an error or inconsistency in the report, contact us immediately to discuss.
14. Third-Party Use of Report
The inspection report is prepared for the benefit of the client who commissioned the inspection. While the report may be shared with real estate agents, lenders, inspectors, and other transaction participants, Next Inspections does not warrant the report for use by third parties and is not responsible for their interpretations or decisions based on the report.
15. Changes to This Disclaimer
This disclaimer may be updated at any time. Your continued use of our services constitutes acceptance of any updated disclaimer. Please review this page periodically for changes.
