1. Agreement to Terms
By accessing and using the website nextinspections.com and booking services with Next Inspections, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our website or services. Next Inspections reserves the right to modify these terms at any time. Your continued use of our website and services constitutes acceptance of the updated terms.
2. Services Provided
Next Inspections provides comprehensive home inspection services for residential properties including houses, condos, townhouses, mobile homes, and new builds. Our inspections cover 9 major home systems and over 400 sub-components, performed in accordance with Canadian home inspection standards and best practices.
Services include:
- Non-invasive visual inspection of accessible areas
- Comprehensive written report delivered same-day or within 24 hours
- Interactive digital report with photos, videos, and color-coded severity ratings
- On-site post-inspection walkthrough and consultation (approximately 30 minutes)
- Follow-up consultation available upon request
3. Scope of Inspection
Home inspections are visual, non-invasive examinations. The inspection does not include:
- Invasive testing or destructive procedures
- Removal of walls, insulation, or finished surfaces
- Radon or mold laboratory testing (referral provided if requested)
- Thermal imaging or specialized equipment use (available separately for additional fee)
- Code compliance verification or permit review
- Estimation of repair costs or remaining useful life of components
- Inspection of areas that are inaccessible, locked, or hazardous
- Evaluation of property value or investment potential
The inspection is based on conditions observed on the date of inspection. Components may fail or deteriorate after inspection completion.
4. Inspection Limitations
Home inspection is a visual assessment only. The following limitations apply:
- We cannot detect all defects, hidden problems, or future failures
- Some issues may be concealed by furniture, fixtures, finishes, or inaccessible areas
- Older homes may have systems or construction methods outside current standards
- Water intrusion, mold, asbestos, lead, and radon require specialized testing (not included)
- Underground utilities, buried pipes, and foundation conditions cannot be fully assessed visually
- Not all minor cosmetic issues will be noted in the report
5. Booking & Payment
- Availability: Inspections are subject to availability. We will confirm the inspection date and time within 24 hours of booking.
- Payment: Payment is due upon booking or on the day of inspection, as arranged. We accept cash, credit cards, and e-transfer.
- Pricing: Prices are based on property type and size. Additional fees apply for properties outside our standard service area or requiring specialized services.
- Cancellation Policy: Cancellations must be made at least 24 hours before the scheduled inspection for a full refund. Cancellations within 24 hours may incur a cancellation fee.
- No Refunds After Service: Once an inspection is completed, no refunds will be provided except in cases where the service was not performed as agreed.
6. Client Responsibilities
- Provide accurate property address, type, and access information
- Ensure the property is accessible and safe for inspection
- Disclose known issues or hazards that may affect inspector safety
- Provide utilities (water, gas, electricity) access for testing
- Be present during the inspection or provide a key/access method
- Inform the inspector of any locked areas or safety concerns
7. Inspector Safety & Access
The client is responsible for ensuring the property is safe and accessible for inspection. If the property poses safety risks (e.g., aggressive animals, hazardous conditions, structural instability), Next Inspections reserves the right to:
- Decline to perform the inspection
- Perform only limited inspection of accessible areas
- Reschedule the inspection when safety can be ensured
No refund will be issued if the client cannot provide safe access or the property is uninhabitable.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEXT INSPECTIONS, ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any defects or issues not identified during the inspection
- Property damage or personal injury resulting from inspection activities
- Loss of property value or failed real estate transactions
- Indirect, incidental, or consequential damages
- Loss of profits, business opportunity, or reputation
- Any damages exceeding the cost of the inspection
This limitation applies even if Next Inspections has been advised of the possibility of such damages.
9. Inspector Credentials & Insurance
Next Inspections is a BC-licensed home inspection company (CPBC License #82971) and operates with current professional liability insurance. However, liability insurance does not cover all claims and damages. All inspections are performed on an "as-is" basis without warranties beyond those explicitly stated in this agreement.
10. Report Accuracy & Use
- Reports are prepared in good faith based on conditions observed on inspection date
- Reports may be shared with real estate agents, lenders, and other relevant parties
- Reports are provided for the client's personal use in the real estate transaction
- Reports should not be altered, edited, or misrepresented to third parties
- We are not responsible for interpretations or decisions made by third parties based on the report
11. Intellectual Property
The inspection report, photographs, videos, and all content are the intellectual property of Next Inspections. You may use the report for personal real estate purposes only. You may not reproduce, distribute, or publish the report without written permission from Next Inspections.
12. Indemnification
You agree to indemnify, defend, and hold harmless Next Inspections, its owners, employees, and agents from any claims, damages, or losses arising from:
- Your use of our services
- Breach of these Terms of Service
- Your failure to provide accurate property information
- Your failure to disclose known hazards or safety concerns
- Injury or property damage occurring at the property during inspection
13. Dispute Resolution & Governing Law
These Terms of Service are governed by the laws of British Columbia, Canada. Any disputes arising from these terms or our services shall be resolved through:
- Good faith negotiation between the parties
- Mediation, if negotiation fails
- Arbitration or court proceedings in British Columbia
14. Use of Website
You agree not to use our website for:
- Illegal or fraudulent activities
- Harassment, abuse, or threats
- Unauthorized access or data scraping
- Distribution of malware or harmful code
- Violation of intellectual property rights
- Spam or unsolicited communications
15. Third-Party Links & Services
Our website may contain links to third-party websites and services. We are not responsible for the content, accuracy, or practices of external sites. Your use of third-party services is at your own risk and subject to their terms and policies.
16. Modifications & Termination
Next Inspections reserves the right to:
- Modify or discontinue services at any time
- Modify these Terms of Service at any time
- Refuse service to any person or entity
- Terminate access to our website or services for violation of these terms
17. Entire Agreement
These Terms of Service, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Next Inspections regarding your use of our services. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect.
